Re: NRC Licensing Conditions



The NRC is given the authority in the CFRs to impose additional conditions on
a licensee. However, the licensee has the right to challenge the NRC to
demonstrate the objectivity and feasibility of any such condition before so
accepting it as a license condition.

This protective measure is crucial. It prevents adventurism on the part of
regulators who might wish to conduct regulatory complaince research at the
expense and responsibility of a particular licensee.

Another compelling justification for this licensee safety mechanism is to
help prevent any particular licensee from being placed in a noncompetitive
position due to being burdened by an otherwise unjustifiable condition which
calls for performance above and beyond those required of other similar
licensees.

The vast majority of regulators are good decent folk, but it seems there are
always a few who love to spend your radiation safety program money for you.
Make centain you get your money's worth from your license.
