DOE regulation



In a recent meeting it was noted that to effectively externally regulate the
radiation activities of the DOE it would be necessary to change the Clean
Water Act, the RCRA act, and other environmental statutes to bring DOE
under the purview of the EPA.  This of course would create a different
radiation control scenario for the DOE than that that exists for other
users of sources of radiation (material and machine produced).  Should
this method be pursued or should DOE be externally regulated by the
Nuclear Regulatory Commission and the state radiation control agencies
just as are all other user  of sources of radiation?  Are there any
reasons why DOE should not be regulated?
