 Yes, anyone may own material under the general license in 10 CFR 31.9:
 "A general license is hereby issued to own byproduct material without regard
 to quantity...a general licensee under this paragraph is NOT authorized to

FYI on your question about who to notify about this item being sold without a
license. Please note that I have notified the appropriate group at eBay, the
internet on-line auction center,  that this Americium source should not be
sold to members of the public by a member of the public without proper
license. See my e-mail below:

Dear eBay:

It is a violation of Federal law for any individual or company to possess,
sell, or ship this source without a proper license from either the Nuclear
Regulatory Commission, or a State radiation protection agency if the state is
what is called an Agreement State acting on behalf of the NRC.

There is no federally mandated "Exempt Quanity" for Americium-241 [the correct
spelling of the isotope involved, not Americum as listed]. This Americium
check source should not be sold through eBay or in any way through open
commerce by individuals not licensed to do so.
