Hi Group:
This posting deals indirectly with radiation safety and more directly with
NRC authority to license nuclear facilities in the USA:
The 10th Circuit Court of Appeals (the second-tier court just below the US
Supreme Court) will hear arguments about NRC's licensing procedure for
uranium deposits in NW New Mexico in May.

Since I've provided affidavits to two NRC Administrative Court processes on
these licenses, I'm quite interested.
The last time that that the 10th Circuit Court heard a case involving the
NRC was the 2004 ruling was the "THE SKULL VALLEY BAND OF GOSHUTE INDIANS
and PRIVATE FUEL STORAGE, L.L.C. v. DIANNE R. NIELSON (and the State of
Utah) involving the question of licensing Away From Reactor Spent Fuel
Storage. The following hyperlink provides the written opinion of the court
in the 2004 case.
