[ RadSafe ] Are Rare Earths Exempt from NORM Regulations?

I'm posting this query on behalf of Prof. Max Scott.  Kindly respond to

Most if not all states exempt rare earths containing less than 0.25%
uranium and thorium from licensing.  Some states have promulgated
specific NORM regulations. 

 

Does one have to comply with the NORM regulations if they meet the
exempt concentrations?

 

Comments, advice, and suggestions requested.

 

It would be great to hear from regulators.
