Euro court again rejects nuke illness case vs UK
STRASBOURG, France, Jan 28 (Reuters) - The European Court of Human
Rights on Friday rejected a request to revise its own 1998 judgment
throwing out a case against Britain by two army veterans over
exposure to nuclear tests.
The court, in its initial judgement ruled that Britain respected
procedural rules that would have allowed Kenneth McGinley and Edward
Egan to be given a pension if they had suffered from exposure to
radioactivity.
The men had said their health deteriorated as a result of exposure to
nuclear tests on Christmas Island in the 1950s.
They appealed the 1998 decision saying they did not have all the
necessary information and documents at the time they first filed
their appeal.
But the court ruled on Friday that is was ``satisfied that the
applicants had sufficiently detailed knowledge'' of documents and
``the request for revision was, accordingly rejected.''
