Yes if it has real radiation signs on it seems like it would be a placarding violation.  I know that PUCO here in Ohio takes such things seriously as they regulate common carriers and private commercial carriers.  We have also had mislabeled boxes used by companies in Ohio that received federal regulatory attention.  One was a box that was mislabeled to discourage theft of equipment inside it.  If nothing else it seems that it is analogous to shouting fire in a public space when there is none.
  
Perhaps now that this has been pointed out, some regulator could take action?  (hint, hint)
