ANSTO plays down French refusal of spent nuclear fuel



Court finds sales of plant land to antinuclear citizens legal



NIIGATA, Japan, March 16 (Kyodo) - The Niigata District Court on 

Friday upheld as legal the sales of a total of 743 square meters of 

municipal property located within a nuclear plant construction site 

in the town of Maki to residents opposing the plant project. 



Presiding Judge Noriyoshi Katano said Maki Mayor Takaaki 

Sasaguchi did not abuse his power in selling the plot to 23 

residents in August 1999 based on contracts struck at his 

discretion. 



The plaintiffs in the case, who support the nuclear power plant 

project, claimed the mayor exceeded his authority in selling the 

plots, which caused construction of the plant to be effectively 

frozen. They also said he agreed the contracts with the residents in 

secret in violation of the law. 



Residents of the town on the Sea of Japan coast have been divided 

over the 30-year-old plan by Tohoku Electric Power Co. to build the 

nuclear power plant. 



In a referendum held in August 1996, about 60% of Maki residents 

voted against the construction project, but a majority of assembly 

members support it. 



The mayor said his decision to sell the plot was based on the 

results of the referendum and thus legal.
