May 3rd Barnwell Update

The latest in the continuing Barnwell saga....

The Southeast Compact Commission (SECC) voted to disapprove the SC
request to open Barnwell on a national basis. In a 10-6 vote (1 vote shy)
the request was denied. By the same margin, the exclusion/expulsion of
NC was also denied.

Gov. Beasley (R-SC) met with SC Senate leaders to solicit support for
the next move. He wants legislation passed to allow SC to withdraw from
the SE Compact. He appears to have Senate support. FYI the SC Senate
is also controlled by Republicans. Gov. Beasley's spokesperson said
the proposal has not been completely drafted at this time.

My comments:
At the present time, it is unclear whether SC will "go it alone" or
join/form a new compact.
If SC does not join/form a compact, then out-of-state waste cannot
be excluded due to interstate commerce and restraint of free trade
laws.

More updates as news warrants.
