     Regarding Mixed Waste - Another good guidance is the Waste Acceptance 
     Criteria issued by the Compact of the area that your facility is 
     located in.  Additional concerns for mixed waste may be imposed by the 
     legislature of your home state.
     
     For example, in Ohio, the General Assembly has issued several statutes 
     that affect mixed waste.  One prohibits the co-mingling of llrw and 
     hazardous/solid waste materials.  A second is stated in our Compact 
     amendments which prohibits the disposal of mixed waste at the proposed 
     Midwest Interstate Compact llrw disposal facility planned for Ohio in 
     the "near" future - about ten years the way things are going.
     
     Our Compact waste acceptance criteria also prohibits the acceptance of 
     mixed waste for the facility.

     There was a feature article on this in the HPS newsletter in November, 
     1995.  It describes the dual role of both the NRC and the EPA in 
     controlling mixed waste.  On August 8, 1995, both agencies published a 
     joint guidance on the storage of mixed waste in the Federal Register.  
     Basically, the Atomic Energy Act of 1954, the Solid Waste Disposal Act 
     (SWDA), the Resource Conservation and Recovery Act (RCRA), Hazardous 
     and Solid Waste Amendments of 1984, the Low-Level Radioactive Waste 
     Policy Amendments Act (LLROPAA) of 1985, and the Federal Facility 
     Compliance Act (FFCA) all deal with the issue of mixed waste.  The 
     above guidance is very helpful in assuring compliance with existing 
     regulations.

 Bill Lipton raises the question of "free release or unregulated disposal"
of exempt quantities.
     
I assume that these "quantities" are considered Low Level Radioactive 
Waste.  I once disposed of a check source which was a mercury compound and 
found myself in the never-never land of "mixed waste".
     
These items may be below regulatory concern but it would appear that they 
can still stick to you like fly paper.
     
In broad terms what are the regulations that control LLWR and mixed waste.
