Rad Equipment Exemption



Code Rule 38 from the NY State Dept. of Labor ("Ionizing Radiation")
lists the following exemption:
"Exemption 11.  Radiation equipment which by reason of its design
cannot emit radiation at a level which, when measured 5 cm from
the surface of such radiation equipment with all external shielding
removed, exceeds a rate of 0.5 millirem in any hour.  This exemption
does not apply to the testing or servicing of such equipment during
the production thereof."
As far as I can tell, this Exemption has been in place since the mid-60s.
Do other States have a similar exemption?  What is the intent (ie, is
it meant for a specific type of equipment such as CRTs?)?  Would you
interpret this to include electron microscopes (SEMs or TEMs)?  Why
or why not?
