DOE/NRC Release Limits vs. DOT contamination limits

A New Twist..........
With the decommissioning criteria moving into the marssim realm,  what happens
when a radiologically licensed facility's  unrestricted release limits exceed
the DOT definition of radioactive material (49 CFR 173.403);  thus, requiring
the material to be transported as a hazardous material (specifically, a
radioactive material, excepted or otherwise) to a non-licensed industrial
landfill for disposal. 
This is the exact opposite of the old scenario "you can't ship non-radioactive
material into this licensed site."
NRC/Argeement States regulate radioactive material for disposal and the DOT
regulates radioactive material in transport. 
And yes has been a common occurrence in recent weeks.
