I was there for the last emergency drill. It was licensed to the 5% start-up level (I think). In all probability, the drill and 5% were posturing by Long Island Light to get the state to buy them out. I think Long Island Light (and Gas) saw the writing on the wall and was using those to get the state to hurry things along.
I think the folks who bought in to that whole deal were either ignorant of stupid.
Yeah I know about the Md thing (I live in VA, just outside of DC). I get the feeling that the people of MD were told they were going to a free market, even though there was a price cap on the rates. Nobody was smart enough to realize that "there ain't no such thing as a free lunch (TANSTAFL, from Heinlein's The Moon is a Harsh Mistriss).
We apparently had a similar deal here in VA, only now the state legislation is looking to modify the ban on rate changes.

There is talk in Maryland of delaying both the gas and
electricity rate increases for individuals. However,
if you choose to do that, you will have to make up the
difference in a few years.
