The courts in Australia awarded a widow a pension for colon cancer from a soldier who served in Japan near Hiroshima from 1946 to 1955. The claim argued the “hot particle problem” in that the court ruled that dose to any part of an organ, including an individual cell, was valid under Australian law, and Busby then used the 63 Kg of HEU to argue that microscopic particles of uranium irradiated individual cells in the colon for years. A dose to a part of the colon that was greater than 0.1 Sv for more than 5 years was asserted.
It does not appear that the ARPANSA expert who countered Busby was prepared to argue hot particles, since the 2002 study did not consider that issue.
