The reality of the matter is that the University should not be cited.
I see Bill's point, and I believe his opinion is based on how this
type of incident, a willful act, is adjudicated by the NRC in a power
reactor setting. Whenever a willful act was performed at a power
reactor, the NRC believed that blame had to be assigned, and their
opinion was that the Licensee must always shoulder that blame. There
were many instances where the utility could take no action to prevent
an occurrence, yet the upper management was summoned to the regional
headquarters to address the issue, and to identify what
countermeasures would be employed to prevent recurrence. All of this
being a case of futility. The simple logic is, that to prevent any
willful acts, there must be a "shadow" assigned to each individual.
And what do you do about collusion between the 2 individuals? Do you
assign a 2nd "shadow"? Preposterous! The goal of management is not to
baby-sit. The reality is that when an individual is set on performing
an unlawful act, willful as it can be ..., there is really nothing
that can be done, for the significant majority acts. To assign blame
to make someone feel good, the public or other employees, solves
nothing, and prevents nothing .. be they yesterday, today or
tomorrow.
