The simple fact is that the university in question is a victim of a crime -
theft. I know of no provision within the NRC regulations (10CFR) that makes
it a regulatory violation to be a victim of a crime. And, as Sandy pointed,
citing the university will accomplish nothing of value. But, it will
probably happen anyway because the university is the entity over which the
NRC has jurisdiction. In other words, they'll be cited by the NRC because
the agency CAN cite them. Going after the thief is very difficult for the
NRC, and they undoubtedly feel obligated to do something to someone, and
that leaves the university as an easy target.
