remediation required for "surplus property"



The attached notice from today's (August 23, 2000) "Federal Register"
should serve as a caution to RP's when their site wants to sell
potentially contaminated, "surplus property."  Apparently, DOE properly
released the material, in accordance with existing standards.  However,
they had to remediate the property of the "customer," who was a site
employee, when the standards became more restrictive.  They also
overlooked the potential for RCRA materials leaching out.  I imagine
that this was big $$$.  It would have been much cheaper to send the
material to a licensed disposal facility.
