You raise an interesting question.  We agree that such an exposure

would not, techniically, be permitted by our regulations.  However, if a

judge makes an informed decision and issues a court order, we would

allow the exposure.



Alternatively, we could seek statutory authority and write a

corresponding regulation to allow such an exposure but that would requre

a lot of resources so we'll opt for the common sense approach.

I believe that the diagnostic radiation dose applied to the man would

have

been illegal in NJ as it had no medical benefit to the person. Any

comments

from NJ DEP personnel?
