Mike,
1. Anyone can own or have title to radioactive material under a general
license issued pursuant to 10 CFR 31.9 or equivalent agreement state
regulations. It is the receipt, possession and use of radioactive
material that is subject to a specific or other forms of licenses.

The primary licensee (Company A) transfers the source to
(Company B) for testing etc. The source is then under
Company B's radioactive material license upon receipt by
Company B. The shipper, Company B, is then liable for
transport of the source. The carrier is an agent for
Company B and is liable to the extent provided under the
applicable contracts and tariffs between the shipper and
carrier.

Previously there was a thread on the BB concerning transportation of
radioactive materials. When a source (neutron source) is accepted by
a company for testing, packaging and shipping can that company accept
the source on its NRC license, and then assume the liability for
transport? Or does the source remain on the license of the primary
owner until received by a new owner and not be on the shipping
company's license? The CFRs address that under an NRC licensee (has
the) "... right to receive, acquire, own and possess..." Who has the
liability?
