This is in response to a discussion earlier.
Today the Supreme Court ruled on the bad-job-reference/retaliation
issue, and said that the person(s) giving the offending reference can be
liable.

Justices let ex-workers sue over bad job references
WASHINGTON - Companies can be sued by former employees who say they
suffered retaliation - such as a bad job reference - for accusing the
employer of discrimination, the Supreme Court ruled Tuesday. Voting
unanimously in a Maryland case by Charles T. Robinson Sr. against his
former employer, Shell Oil Co., the justices said a federal job-bias law
gives former employees the same protection against retaliation as
current employees and job applicants.
