Byproduct material is also defined in 10 CFR 40 as "the tailings or wastes
produced by the extraction or concnetration of uranium or thorium from any ore
processed primarily for its source material content, including discrete wastes
resulting from uranium solution extraction processes."

As one of the radionuclides in the U-238 decay chain, Po-210 would be
considered byproduct material if it was extracted from spent uranium ore.
