   DOE Order 435.1 described "incidental waste" as material that would be left in the tanks because of the high degree of effort needed to remove the dregs.  On July 3rd of the this year a US District Court judge issued a Memorandum Decision which states, in part,



"It is further ordered, adjudged, and decreed, that the DOE has violated NWPA by promulgating Order 435.1 as it relates to incidental waste, and that portion of Order 435.1 is declared invalid under the Administrative Procedures Act..."(http:www.id.uscourts.gov and search for docket # 01-413)



   It seems that the option of in-place stabilization has been removed from the table for now.
