FedEx Express Embargos Connecticut Yellow III

Effective last Wednesday, August 11, 2004 FedEx Express embargoed all

Radioactive Yellow III shipments from, into and through the State of

Connecticut because of permitting requirements by the Connecticut Department

of Transportation.  The U.S. Department of Transportation issued

Inconsistency Ruling 21 (IR-21) in 1987 finding Connecticut's radioactive

permit requirements inconsistent with Federal law and hence pre-empted.

Connecticut appealed and the appeal was denied in 1988.
